Terms and Conditions
1/ Legal regime applicable to the rental contract
Depending on the actual residence in question, the rental contract is subject either to the legal statute applying to residences providing services, or to that which applies to registered tourist residences. This rental contract is concluded with respect to temporary accommodation only and the premises cannot be used as a main or second residence. The occupant shall not carry out any commercial, industrial or professional activity on the premises, nor invoke legal provisions applying to rental property leases, such as those regarding maintenance and repair. Consequently, the contract will be subject to the provisions of the French civil code and the present terms and conditions.
2/ Bookings
Bookings for apartments in any “hipark” residence are confirmed once “hipark” has formally accepted the reservation. Such confirmation is entirely at the company’s discretion.
Bookings made either through the central booking facility, or directly with a specific residence, are only confirmed when guaranteed by a valid credit card issued by a bank (in compliance with the conditions in article 3 below), or as part of a prior agreement regarding the opening of an account with “hipark”.
Reservations made via the website, www.hipark-residences.com, are firm and binding as soon as payment has been made online via the website.
3/ Credit cards accepted and other means of payment
Online: American Express, Visa, Eurocard-Mastercard.
On site: American Express, Visa, Diners Club, Eurocard-Mastercard and cash (EUROS accepted only, subject to the maximum stipulated by prevailing regulations).
For groups and businesses: American Express, Visa, Eurocard-Mastercard, bank transfer.
4/ Deposits
A deposit, payable in advance, is required to confirm group bookings (8 people minimum). Further details concerning amount of deposit, when it is to be paid and any cancellation conditions, will be specific to each individual contract and described therein.
Should the deposit not be paid either by credit card or, in the case of group or company bookings, by bank transfer, according to the conditions specified and by the stipulated date, the booking will automatically be cancelled.
5/ Conditions of payment
All “hipark” residence invoices are payable immediately. All or part of the rental fee is payable on arrival (depending on length of stay): for rentals exceeding two weeks, clients will be invoiced in advance on a fortnightly basis. In the event of an agreement whereby rental charges are to be paid by a third party, the person actually occupying the apartment remains liable for said payment.
Charges for optional extras are payable on vacating the apartment.
In France, any sums still outstanding on the due date will automatically, and without prior notice, be subject to monthly interest charges, calculated at 1.5 times the prevailing legal interest rate.
6/ Prices
Prices are in euros and are inclusive of taxes (apart from tourist tax), but do not include breakfasts, optional extras or car-park charges. Prices are per apartment per night and vary according to season and length of stay.
If city taxes are subject to VAT, this charge will be passed on to the customer.
The price includes:
- use of the apartment
- reception and concierge services 24/7
- house-keeping (*)
- use of the fitness room and sauna during opening hours (subject to the conditions described below)
- use of the business corner, including free internet access; printing of documents will be invoiced according to the prevailing rates (rates available at the residence reception)
- use of the swimming-pool during opening-hours, where applicable.
Prices are valid until December 31st each year and are inclusive of VAT charged at the rate applicable at time of payment.
Prices are subject to review without prior notice and no optional extras are included in the price, irrespective of the town involved.
Prices do not include the local tourist tax, which varies according to the town where the residence is situated and is payable directly to the residence in question. Tourist tax is calculated per person per day.
If payment is made online, city taxes will be included on the customer's invoice.
No alcohol is sold at “hipark” residences other than by outside caterers.
(*) House-keeping services are carried out every two days, for rentals lasting between one and six nights, weekly for average and longer stays. For requirements beyond those described, a range of optional services is available at extra charge.
House-keeping services comprise general cleaning of the apartment, fresh sheets and towels and new complimentary toiletries.
7/ Children
"hipark" allows minors to accompany their parent(s) during his/her/their stay.
However, "hipark" cannot accept unaccompanied clients who have not passed their 18th birthday.
All minors staying in a "hipark" residence (whatever their age and whatever the reason for their stay), must be accompanied by one of their parents, or an adult member of their family, throughout their entire stay.
Whilst on the residence premises, children are the responsibility of their parents and under their supervision.
There is no charge for children under two years old staying in their parents’ apartment. Advance booking of a baby-care kit (highchair and cot) is recommended. Children aged over two are taken into account with respect to occupancy.
For example, a family comprising two parents and two children, aged two or over, will be accommodated in an apartment intended for 4-person occupancy and will be charged accordingly. The hire charge will therefore be for 4-person occupancy.
Extra beds are not available in our residences.
“hipark” can provide clients with details of baby-sitting services. Clients use such services at their own risk. Payment is made directly to the service-provider by the client.
8/ Alterations to length of stay
Stays in a “hipark” residence can be extended, subject to availability and at the company’s discretion, but not necessarily in the same apartment or at the same price.
In the event of early departure, where a minimum of 72 hours’ notice has been given, clients will be charged only for the actual length of stay. In cases where the minimum notice has not been given there will be no reduction in charge.
9/ Cancellations
- Individual clients
For stays of under 7 nights, cancellations or alterations made at least 24 hours before the date of arrival do not incur a penalty.
For stays of over 7 nights, 72 hours’ notice is required.
In cases where the minimum notice is not given, cancellation charges are as follows:
1 night’s rental for bookings of under 7 nights, 2 nights’ rental for stays of 7 to 30 nights, and 3 nights’ rental for stays of 31 nights or more.
Failure to arrive, without prior notice, will be subject to the above-mentioned cancellation charges.
- Groups and businesses: specific conditions are detailed in each individual contract.
If any city taxes have been prepaid, this amount will be refunded to the customer in the event of a cancellation or no show.
10/ Your obligations
Apartments are provided in good, clean condition and residents are expected to use the premises and fixtures and fittings therein with due care and attention, as described in the French Civil Code. Residents must behave appropriately, showing respect for others and the residence environment.
An inventory is provided in each apartment. Residents should check the inventory on arrival, ensuring that the apartment and its contents are as described: any discrepancies or missing or damaged items must be reported to reception within two hours of arrival. On departure, “hipark” will check the inventory and the condition and cleanliness of the apartment and its contents: any changes, missing items or damage noted, whether to the apartment or its contents, will be repaired or replaced, at the client’s expense (including labour costs where applicable), on the basis of new identical replacement value.
“hipark” has the client’s express permission to allow its representatives to enter the apartment for purposes of cleaning and maintenance. “hipark” reserves the right to enter the hired premises for any legitimate purpose pertaining to the safety of people or goods or, in cases of force majeure, in order to take any steps, precautionary or otherwise, that may be deemed necessary in view of the emergency.
Residents using the internet are deemed to accept the terms and conditions detailed in the “hipark” residences’ internet use charter.
Clients and their children have free access to the fitness room and swimming-pool (in residences equipped with a pool) at the times indicated in each residence. Use of such services is entirely at the client’s own risk: “hipark” does not provide supervision of any such activities and children must be supervised by their parents at all times.
The sauna is available for use by residents at the times indicated in each residence. Access to the sauna is strictly prohibited to children.
Pets other than guide-dogs are not allowed inside the residences.
The number of occupants using any apartment must not exceed the maximum occupancy permitted by “hipark”, calculated according to the maximum number of beds (studio: 2 people, suite: 4 people, DELUXE suite: 6 people).
11/ Arrivals and departures
Keys are available from 3pm on the day you arrive. Keys must be returned by 11am on the day you leave (should this not be the case you will be billed for an extra night’s stay).
12/ Responsibilities
HIPARK cannot be held responsible in the event of theft or damage to personal effects, whether occurring in the apartments (including personal safes), communal areas, car-parks or any other building or annexe belonging to the residence: as this hire contract is subject to regulations regarding registered tourist residences, the provisions of articles 1952 and following of the French Civil Code, which relate to hotels, do not apply.
“hipark” cannot accept any liability regarding food-poisoning, allergies or other ill-effects on health arising from the consumption of food brought in from outside the residence, including food provided by caterers.
“hipark” cannot be held responsible for events or damages to persons or goods occurring in the residence car-park. Residents are advised not to leave any items on view inside their vehicle.
Means and times of access to car-parks are specific to each residence: clients are expected to comply with the regulations indicated (particularly regarding size of vehicle and prohibited access for LPG vehicles).
The sauna is for mixed use and users do so entirely at their own risk. “hipark” cannot be held responsible for any health problems arising from using the sauna.
Use of the fitness room and/or swimming-pool (in residences equipped with a pool) is at the discretion of individual clients, and “hipark” cannot be held responsible for any health problems arising from taking part in sporting activities.
Children’s use of the fitness room and/or swimming-pool is at the discretion of their parents, who must accompany them on every occasion and remain responsible for them at all times.
13/ Access to visitors
In In the interests of client security (of persons and goods, as well as a precaution should the building need to be evacuated in the event of fire), and allow "hipark" to know who is on the premises at all times, visitors must report to the reception desk, deposit their ID and sign the visitor register.
Their ID will be returned to them when they leave the premises.
14/ Alterations to services provided
In certain circumstances, relating to cases of force majeure and beyond the company’s control, HIPARK may be obliged to alter the services it provides, either partially or in full, regarding accommodation and/or optional extras such as breakfast. Residents will not be charged for the services in such cases, but no compensation will be offered.
15/ Termination – Sanctions – Non renewal
In the event of a resident failing to observe any of the above-mentioned obligations, or behaving in such a way as to disturb other residents, the contract will automatically be terminated, immediately and without notice. The resident will be asked to leave the premises immediately and evicted, if necessary, with the assistance of officers of the law.
16/ Legislation
The rental contract is subject to French law.
In the event of a dispute, the relevant legislation is that of the French Republic, and proceedings shall be subject to the jurisdiction of the court in whose jurisdiction “hipark” is domiciled, even if more than one defendant is involved.
